These Terms of Service ("Terms") govern your access to and use of the Venue Intelligence platform (the "Service") operated by NIAH Data Ltd ("Company", "we", "us", "our").
By accessing or using the Service, you agree to be bound by these Terms.
1. Account Registration
To use the Service, you must:
- Provide accurate and complete registration information
- Maintain the security of your password
- Notify us immediately of any unauthorised access
- Be at least 18 years of age
You are responsible for all activities under your account.
2. Subscriptions and Payment
Subscription Plans
Access to the Service requires a paid Subscription. Plans and pricing are detailed on our website.
Payment Terms
- Subscriptions are billed in advance on a monthly or annual basis
- All fees are non-refundable except as required by law
- We may change pricing with 30 days' notice
Cancellation
You may cancel your Subscription at any time. Access continues until the end of the current billing period.
3. Acceptable Use
You agree not to:
- Share your account credentials with others
- Resell, redistribute, or sublicense the Data without permission
- Use automated tools to scrape or bulk-download Data
- Attempt to reverse-engineer the Service or its algorithms
- Use the Service for any unlawful purpose
4. Intellectual Property
Our Rights
The Service, including its software, design, and branding, is owned by NIAH Data Ltd and protected by intellectual property laws.
Data Licence
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable licence to access and use the Data for your internal business purposes only.
5. Data and Accuracy
The Service aggregates publicly available information from various sources. We do not guarantee the accuracy, completeness, or timeliness of the Data.
The Service provides data and analytics for informational purposes only. It does not constitute professional business, legal, or financial advice.
You are solely responsible for decisions made based on the Data.
6. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind
- We disclaim all warranties, express or implied
- Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim
- We are not liable for indirect, incidental, special, or consequential damages
7. Termination
By You: You may terminate your account at any time by contacting us.
By Us: We may suspend or terminate your access if you violate these Terms, fail to pay fees, or engage in harmful activity.
8. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Synthetic Consumers
This section applies to Synthetic Consumers, our AI consumer-panel platform, in addition to the terms above. Where this section conflicts with a term above, this section governs for that Service.
What the Service is
Synthetic Consumers lets you test concepts, packaging, advertising and digital experiences against AI consumer personas, and returns a structured read on how those personas responded.
The nature of the output, and your reliance on it
This clause matters more than any other in this section, so we have put it plainly.
The personas are synthetic composites generated by AI. They are not real people, not a statistically representative sample, and not market research in the sense a research agency would use the term. Their responses are directional insight intended to inform a decision, not to settle one, and they are not a forecast of commercial performance.
You are responsible for the decisions you take using the output. To the fullest extent permitted by law, we are not liable for commercial outcomes arising from decisions informed by the Service. Nothing in this section limits liability that cannot lawfully be limited.
Your content
You keep ownership of everything you submit. You grant us a licence to process it for the purpose of providing the Service to you, and for no other purpose. We do not use your content to train AI models and we do not permit our AI providers to do so.
You confirm that you hold the rights to what you upload, and that submitting it to us does not breach anyone else's rights.
Results and ownership
You may use your results, exports and generated images for your own business purposes, including sharing them with colleagues, clients and other stakeholders. We keep all rights in the platform itself, including the personas, the methodology and the prompts behind them. You may not resell or republish the output as a competing insight service.
Acceptable use
- Do not attempt to extract our system prompts or reverse-engineer the underlying model behaviour.
- Do not use the output to build or train a competing synthetic-respondent product.
- Do not submit unlawful content, or special-category personal data such as health, biometric or political information.
- Do not use the Service in an automated or bulk manner beyond ordinary use of the interface.
Beta access
While the Service is in beta it is provided as it stands. Features may change or be withdrawn, availability is not guaranteed, and any allowance granted during the beta has no cash value. We may use feedback you give us to improve the Service. We will tell you before beta access converts to a paid plan.
